Babysitter who forced boy, 13, to carry out sex acts on her at onesie party avoids jail

Mary-Ellen Mooney rubbed the boy's thigh and kissed him before putting his hand down her knickers while babysitting him, a court heard.

Mooney committed the sex acts on three separate occasions during an evening looking after the boy who was in the house with his friend who had been playing computer games.

Two days later, Mooney sent the boy Facebook messages where she referred to him as a "babe" saying that she had "a real soft spot" for him and believed the boy had "a hidden talent."

The shocking abuse came to light when a member of the boy’s family complained to police.

Mooney was arrested and charged with two offences, which she initially denied before finally admitting her guilt on what was meant to be the morning of her trial.

Her victim, who cannot be named for legal reasons, had already come to court ready to give evidence against his babysitter at the trial, which was scheduled to take place last month.

Mooney, now aged 19, looked on from the court dock and showed no emotion as she was handed a suspended jail sentence today.

The offences were committed at the boy's home over the weekend of January 10 and 11 when Mooney was aged 18.

Graham Smith, prosecuting, said Mooney found her victim and his friend in his bedroom playing computer games when she arrived to babysit.

Noticing they were both wearing onesies, she suggested having a onesie party and went back home to change into hers.

When she returned, she suggested watching a film downstairs.

Mooney's victim agreed to come and watch with her, but the friend stayed upstairs in the bedroom playing video games.

Mr Smith told the court: "She started touching him on his upper thigh.

“He asked her to stop, which she did, before pretending she had been winding him up.

“He started to become sexually excited, got up and went upstairs to the bedroom.

“As she followed, she said she was winding him up and they went back downstairs.

"She put on the music channel and started dancing.

“She then sat on top of him, straddling him face to face and kissed him on the lips.

“He described it as open and closed mouth, but with no tongues. He didn't feel like he wanted to kiss her back.

"She got up and went to get a drink. The complainant went upstairs and told his friend what had happened and said it was disgusting." 

Mr Smith said the boy went back downstairs and found Mooney had by now changed into pyjamas,

He said: "She sat in front of him with her back to him. She pulled his right arm around her body, as if to hug her.

"She took his right hand and placed it inside her pyjamas and onto her vagina area.

“She took her hand out, leaving his there, before placing her hand over his through the clothing and started to move his hand back and forth."

Mr Smith said the boy's hand did not penetrate Mooney's vagina.

Two days later, he said, Mooney sent a number of sexually explicit messages to the boy through Facebook.

The court was told the messages read: "We should meet up, just me and you. Keep it hush hush - don't tell [the friend].

"You are fairly mature for your age and you're not bad looking.

“I have got a really soft spot for you, babe.

“I think you have a hidden talent. I think you could handle me.

"You are going to take control of me and show your dominant side.

"It isn't about size, it's the way you use it. There's no point having a big d*** if you don't know how to use it.”

During the exchange she also said she “could get into trouble” if anyone else read the messages.

Mooney was arrested nearly a week later after the boy's family complained to the police. 

During the interview she claimed the boy said he wanted to smoke cannabis, before saying he had instigated the sexual activity, Mr Smith told the court.

Sophie Murray, defending, said: "She has had to cope throughout her young life with her personal circumstances of very poor parenting.

“There was an absent father and her mother an alcoholic.

“She was the carer within the family for her mother, whose alcoholism at times was very bad.

“She subsequently died when she was 13.

"She hasn't, despite that very dysfunctional upbringing, until now committed any other crimes.

“She has had jobs and hasn't sought reliance on the state for income."

She said Mooney had held jobs at a branch of Starbucks and at a telemarketing company but had lost both of them since her offending came to light.

Miss Murray said: "She has a capacity to work and look after herself and to prove that she can be a contributing member of society.

"She has accepted her guilt. She is deeply shameful and guilt-ridden about what has happened."

She said Mooney should have any jail sentence suspended so that she would benefit from one-to-one courses aimed at teaching defendants appropriate sexual behaviour - something Miss Murray said is not made available to serving prisoners.

Miss Murray added the probation service had raised concerns over her mental health, with experts saying she had difficulty recognising boundaries on sexual matters.

She must be supervised throughout the two years, undertake 100 hours of unpaid work and be the subject of a three month curfew between 7pm and 6am.

On count two, of inciting a child to engage in sexual activity, relating to the Facebook messages, she was given a concurrent 12 month sentence, which was suspended for two years.

Mooney, of Black Heath Cresent, Bradwell Common, Milton Keynes, Buckinghamshire, was also made the subject of a five-year Sexual Harm Prevention Order, banning her from unsupervised contact with boys under the age of 16, and has been placed on the Sex Offenders' Register for 10 years.

Judge Karen Holt, sitting at Amersham Crown Court, said: "You were trusted to be the babysitter. You clearly knew what you were doing was wrong.

"I don't have a victim impact statement but there is reference in the papers I have read to [the boy] becoming withdrawn after this happening.

"I have listened very carefully to everything said on your behalf - I don't find this an easy case.

"The law reflects the seriousness of this abuse of trust on a child so young.

“As far as you are concerned, it is right I take into account the background - you have a sad background.

“You have not got into trouble despite your poor parenting.

"Bearing in mind your age and lack of previous convictions, your case doesn't meet the criteria for any form of imprisonment for public protection.

"A custodial sentence is appropriate. I have spent some time, bearing in mind all the circumstances, on whether that has to be an immediate custodial sentence.

“I am just about persuaded I don't need to send you to prison today."

On count one, of causing a child to engage in sexual activity, Mooney was given a two year prison sentence suspended for two years.

Her father Rashid Mulla, 60, and mother Amina Bibi, 50, first realised something was wrong when she hadn’t opened her eyes two months after birth. 

Her mum Amina Bibi, 50, said: "She was born with thick heavy eyelids and she looked different to my other children at birth but we didn’t think anything of it until we realised she couldn’t open her eyes properly.

"When we took her to the hospital she was admitted for six months and they did lots of tests but doctors eventually told us there was nothing they could do.

She added: "Because the doctors told us there was nothing they could do we never went back to them. And as Khadija got older she refused any help."

"Doctors told us when she was a baby that if she attempted surgery she could die, so we have lived with that fear.

"Now that Khadija is much older she has decided herself that she doesn’t want to have surgery. She doesn’t want to risk dying."

Dr Anirban Deep Banerjee, a neurosurgeon from Apollo Hospital, Kolkata, said that the Ms Ms Khatoon could have a "fatal tumour" inside her face.

He has urged her parents to take her for a gene test.

He added: "If she's willing we would need to do a lot of tests to determine how successful surgery would be."

Local government officer, Rupak Dutta, 52, from Kolkata, has taken on the case to fundraise for a life-changing surgery.

He felt compelled to do something after spotting her on the street.

He said: "I’d never seen such a face. I have a 13-year-old daughter and I thought what if she was my daughter? 

"I didn’t even notice tears were falling down my cheeks. I have limited sources to help but I thought the power of social networking would surely help so I posted her photo on Facebook.

Mr Dutta is now in talks with local NGOs who will help Khadija meet with specialists to discuss possible surgery.

Police: 8-year-old charged in beating death of 1-year-old


BIRMINGHAM, Ala. (AP) — An 8-year-old boy is being charged with beating a 1-year-old girl to death while they were left home alone as their mothers went to a nightclub, Alabama police said Tuesday.

Birmingham police spokesman Sean Edwards said the boy beat and killed 1-year-old Kelci Lewis when she wouldn't stop crying. The mother of the toddler, 26-year-old Katerra Lewis, also is charged with manslaughter for her role in the death of her daughter.

"This is by far one of the saddest cases that I have witnessed and been a part of since I became a police officer," Edwards said. "This type of irresponsibility on behalf of a parent is totally unacceptable," he said.

Police said a murder warrant has been obtained for the boy who is now in the care of Alabama's child welfare agency, the Department of Human Resources. His case will go through the family court system.

Edwards said the 8-year-old was the oldest of six children left alone as their mothers, Katerra Lewis and a friend, went to a nightclub on the night of Oct 11. The 8-year old is the son of Katerra Lewis' friend. The friend has not been charged.

A 6-year-old who was in the home that night told police what happened, Edwards said, and the information was consistent with the toddler's injuries. Kelci Lewis suffered severe head trauma and major damage to her internal organs, police said.

Edwards said the 8-year-old is the youngest murder defendant he's ever been aware of in the Birmingham area.

"I believe the 8 year-old is going to require some intense counseling for the next several years," Edwards said.

He said the mother's punishment is "something she has to live with for the rest of her life."

Katerra Lewis has posted $15,000 bond.

Minaj has been away from internet for a full week–ever since controversy erupted over a Halloween video she shared in which she appeared to make fun of a crippled partygoer. Now, many of her fans are asking: Where is Nicki Minaj–and why did she take the week off?

Minaj caused a bit of an uproar last week, after posting a video in which she appeared to shout “Walk!” at a wheelchair-bound Halloween partier. Just before that, Minaj had again been in the news for her use of social media, thanks to the commentary she offered on the also-controversial #PillCosby Halloween costume. Since the “Walk!” video erupted, though, Minaj has been almost completely silent. German ex-leader Schmidt, master of realpolitik, dead at 96



Berlin (AFP) - Former West German chancellor Helmut Schmidt, who died Tuesday aged 96, was an inveterate European, master of realpolitik, and straight-talking elder statesman who commanded respect and headlines into his twilight years.

Schmidt led then-West Germany from 1974 to 1982 as it rose to become a global economic powerhouse.

A centrist from the Social Democratic Party (SPD), Schmidt steered the country through a bloody wave of terror by far-left radicals from the Red Army Faction (RAF), preached free-market economics to his party and embodied cool-headed pragmatic politics in a Europe riven by the Iron Curtain.

Leading tributes to the man she described as "a political institution of our country", German Chancellor Angela Merkel said Schmidt was "an authority whose advice and judgment meant something to me".

President Joachim Gauck said Germany had lost "a great statesman, a person who was so much for us: a politician and publicist, a man of action and an admonisher, but above all, a democrat, a man who knows that freedom also means responsibility and who took on this responsibility."

French President Francois Hollande simply called him "a great European".

Co-publisher of the influential liberal weekly Die Zeit, Schmidt continued to play an active part in international economic debate, including criticising Merkel during the eurozone debt crisis for lacking financial savvy.

He was a popular guest on television chat shows, always granted special dispensation to flout a smoking ban while holding forth with the laconic brand of wit prized in his native port city of Hamburg.

From early on in his political career, Schmidt was capable of sarcasm and impatience, and his delivery of often unconventional views kept him in the public eye decades after retiring.

German media recently grouped him among "Russia apologists" after he expressed understanding for President Vladimir Putin's actions in Ukraine.

As a political commentator, conservative daily Die Welt said, Schmidt's "bite and punchline" earned him great respect across the political spectrum.

- 'Visions? See a doctor' -

Unlike his SPD predecessor Willy Brandt, news weekly Der Spiegel noted in December 2013, Schmidt didn't opt for grand gestures or seminal speeches to break with Germany's past. In another contrast to Brandt, who fled abroad to escape arrest by the Nazis, Schmidt served in Hitler's Wehrmacht.

"He was not loved, but respected," Der Spiegel said, noting Schmidt's knack for pearls of wisdom. "No storm in world affairs seemed to affect his calmness."

Capable of being both amusing and brusque, Schmidt once famously dismissed an interviewer's question, saying: "Anyone who has visions should see a doctor."

Born in Hamburg in 1918, Schmidt was the grandson of a docker, and his father, a teacher, was the illegitimate son of a Jewish banker -- though the family succeeded in hiding its Jewish roots from the Nazi regime.

Schmidt wanted to become a town planner or architect but World War II forced him to put his ambitions on hold and he eventually fought on the Russian and Western front, and was briefly taken prisoner.

He was elected to the Bundestag in 1953, and made a name for himself with his handling of catastrophic flooding in the early 1960s while a regional Hamburg politician.

He steadily rose through SPD ranks to become defence minister in 1969 and finance and economy minister in 1972, before becoming chancellor two years later.

Once in government Schmidt faced difficult challenges, including conflict in the Middle East and a dramatic hike in oil prices that sparked an economic crisis.

He firmly believed in the Atlantic alliance, although he became exasperated by then-US president Jimmy Carter. He also forged a close partnership with French president Valery Giscard d'Estaing, with whom he helped launch the forerunner to G7 summits of industrialised nations.

In 1977 when Palestinian militants hijacked a Lufthansa plane and demanded the release of jailed leaders of the extreme-left RAF, Schmidt ordered the aircraft be stormed.

In the same year, three high-profile figures including a federal prosecutor were killed in a wave of RAF assassinations, bombings and kidnappings that shook West Germany throughout the decade.

- 'One needs will. And cigarettes' -

Schmidt also backed NATO deployment of intermediate-range missiles in Europe in response to upgraded Soviet missiles, but faced opposition from the SPD's youth wing and Germany's peace movement.

Resistance to Schmidt built up across the party -- especially on defence matters -- and he was hospitalised with an irregular heartbeat in 1981 and had a pacemaker fitted.

The decision by coalition partner the Free Democrats to switch alliances to the Christian Democrats in 1982 finally brought Schmidt's downfall through a parliamentary no-confidence vote, and led to conservative Helmut Kohl becoming chancellor.

"Like few others in post-war history, he understood how to surmount crises with courageous intervention of the state," ex-SPD chancellor Gerhard Schroeder wrote in Der Spiegel.

Schmidt was married to teacher, and fellow chain-smoker, Loki, for 68 years until her death in 2010. They had one daughter.

On his 90th birthday, top-selling daily Bild published 90 of Schmidt's most quotable bon mots, including his advice to aspiring politicians: "One needs the will. And cigarettes."

Manchester United's Wayne Rooney slaps WWE superstar at Raw

Wayne Rooney has always had a bit of a temper on him. The fiery former Everton man and current Manchester United star showed it off on Monday night, just not on the pitch.

Rooney was in the crowd for WWE's Monday Night Raw, which took place in Manchester, England. It was there that Rooney had a confrontation with WWE superstar Wade Barrett ... with the footballer coming out on top.

Barrett, who is from England and a fan of Preston North End, called Rooney out during the show, but the tension between the two had actually been building for quite a while. Barrett had called Rooney out on Twitter in February after his dive against Preston North End in the FA Cup.

Before the match between Cesaro and Sheamus, Barrett -- at ringside as an onlooker -- spoke his usual trash, directing it at Rooney.

"You know, Wayne, I would offer to have you step inside this ring so we could fight this out like men," Barrett began. "I would offer, but I would hate for little boy to sit there and watch his own father fail. Because let's face it, he gets to experience that every single time you step foot on the football pitch."

After Cesaro made his way outside the ring during the match and gave Rooney a high-five, Barrett confronted and distracted the wrestler. A short while later, Barrett began yelling at Rooney, pointing a finger in his chest. Then this happened:

Ouch to the smack, and ouch to the words Barrett had for Rooney. Sure, Rooney isn't having a great Premier League season with just two goals in 11 matches, but he is by no means a failure -- on the pitch or in WWE.

Rooney's smack on Barrett provided a distraction that allowed Cesaro to capitalize and win the match.
